16.3 Intention to Dispose of York Park and Associated Land to Stadiums Tasmania FILE NO: SF6660

DECISION STATEMENT: To consider forming an intention to dispose of York Park to Stadiums Tasmania. 

RELEVANT LEGISLATION: Local Government Act 1993 (Tas) Stadiums Tasmania Act 2022 

DECISION: 15 December 2022 MOTION Moved Councillor A G Harris, seconded Councillor D H McKenzie. That the Motion, as per the Recommendation to Council, be adopted. CARRIED 8:3 

FOR VOTE: Mayor Councillor D C Gibson, Deputy Mayor Councillor M K Garwood, Councillor D H McKenzie, Councillor A E Dawkins, Councillor A G Harris, Councillor A J Palmer, Councillor L M McMahon and Councillor A J BrittV Von 

AGAINST VOTE: Councillor T G Walker, Councillor Dr G Razay and Councillor J J Pentridge

 

Dear Mayor and all Councillors,

 

Except for Council’s ATUOMATIC RESPONSE I have not received any notification whatsoever that my ‘OBJECTION’ has be received and that it will be addressed at Council’s next meeting or some other meeting where it will be formally addressed in OPEN COUNCIL. 

 

Given that Government Departments typically have their automatic responses attached to what is being responded to thus proving forensic evidence that what has been received has in fact been received. This is never the case for email correspondence to Launceston Council which means there is the potential for correspondence being bureaucratically misplaced or overlooked. 

 

I am aware that under the appropriate legislation LEGALLY – and in this case specifically – constituents have the opportunity to present an objection in order that it might be deliberated upon and a further determination made – in open council I assume. 

 

I’m taking up that opportunity now and giving notice that I wish to be assured that I am in receipt of due process. Also,  I look forward to receiving confirmation of that by the close of business tomorrow, Friday, December 6.
